Terms of delivery

1. General terms
A. These terms and conditions are valid for all trades made with Ben International spol. s r.o.
B. Delivery of goods is made according to the Trade Law of the Czech Republic also in case of shipping to foreign countries.

2. Prices
A. All prices that are listed are with VAT, which is 20%
B. All prices are shown in CZK, EUR and USD.
C. We have the rights to change price without special anouncement.

3. Receiving and delivering goods
A. Goods will be delivered upon written confirmation of order.
B. If it is not stated differently, all cost of shipping and packing pays buyer.
C. Buyer has the responsibility for the goods since they are shipped out from warehouse.
D. In case of lost or damage of goods buyer must call on his own cost the right insurance company.
E. Buyer have to take the goods that were shipped out according to the agreement.
F. If the buyer will not take goods, he has to pay postage back to the warehouse and pay for keeping goods in warehouse.
G. Ben International spol s r.o. does not take responsibility for not delivering of goods in time in case of „higher force“, also in case of strike, steeling goods in transport, or in case of problems with transport company.

4. Warranty
A. All goods delivered by Ben International spol. s r.o. in Prague will have 24 months warranty, unless otherwise mentioned.
B. This warranty counts only in case that goods were installed and used in normal way and in suitable conditions.
C. The warranty periode counts from the moment of receiving of goods by the customer.
D. Warranty is not possible to use in case that product was damaged in weather catastrofe, in flood, lightening, abnormal heat or freeze etc
E. Buyer have to controll the goods immediately upon receiving. All kind of damages, lost goods, wrong or damaged parts, not complete packages have to be announced to Ben International spol s r.o. in written form within 3 working days.

5. Reclamation
A. It is possible to make recamation of broken goods and give back to Ben International spol s r.o. within 14 days after discovering the problem.
B. Goods will be accepted for reclamation only if the following documents will be shown:
    a) invoice / receipt,
    b) garantie sticker,
    c) original packing (or other proper packing) and explaning of the problem that occured.
C. Eventual cost of transport will be payed by buyer.
D. In case of authorized reclamation Ben International spol s r.o. will decide how to solve reclamation, if the goods will be repaired or replaced.
E. Transport fees which are linked to replaced or repaired goods will be paid by buyer.

6. Payments
A. It is neccesery to make payment before receiving of goods, if not other agreement was made.
B. Payment can be made by cash, by bank transfer or in a different confirmed way.
C. Payment can be delivered directly to Ben International spol s r.o. or to another person who has authorisation to receive payment in the name of Ben International spol s r.o.

7. Ownership of goods
Ben International spol. s r.o. remains owner of the goods untill they are fully paid.
Even in the case that buyer already sold them to a third party.

8. Discount
Eventual discount are possible after discussing the deal between buyer and seller, only in case of delivering bigger amounts or permanent delivery.
